Notice to Membership: Upcoming Vote to Update Our CC&Rs

Dear Kono Tayee Estates members,

The Board of Directors is writing to formally notify the membership that we will soon be conducting an election to vote on proposed updates to the Covenants, Conditions & Restrictions (CC&Rs) for Kono Tayee Estates.

Why this vote is important

Updating our CC&Rs is critical for the long-term health and governance of our community. Specifically:

  • Our current CC&Rs are severely out of date. Many provisions no longer reflect how our community operates today or current legal requirements.

  • Compliance with California law is required. The existing CC&Rs do not fully comply with the Davis-Stirling Common Interest Development Act, which governs homeowner associations in California.

  • This is our third attempt to approve these updates. Previous efforts did not receive the required level of member participation and approval.

  • Failure has real financial consequences. If this vote does not pass, the Board will be forced to petition the court to review and approve the CC&Rs. This process is estimated to cost the Association approximately $5,000 - $7,000 in legal fees, which ultimately impacts all members.

Voting requirement

As a reminder, updating the CC&Rs requires an affirmative vote from two-thirds (2/3) of the membership. This means participation is just as important as how you vote. Every ballot returned matters.

Member engagement and Q&A

To answer questions and provide clarity, the Board will host a Town Hall Q&A session on Monday February 23, 2026 at 7:00 pm. This will be an opportunity for members to ask questions, better understand the proposed changes, and voice any concerns. You can view the current draft of CC&Rs with proposed revisions on the Kono Tayee website under Members/Documents.
