Dear Members,

The Board of Directors is proposing to adopt a comprehensively restated set of Operating Rules and Regulations (the “Proposed Association Rules”) for Home Owners of Kono Tayee Estates. This Notice is provided under Civil Code section 4360, which requires the Board to give Members at least 28 days' notice of a proposed rule change, describe its purpose and effect, and give Members an opportunity to comment before the Board acts to adopt it. The Board will consider all timely Member comments before finalizing the Proposed Association Rules.

Purpose and Effect

The Proposed Association Rules would replace, in their entirety, the Guidelines and Special Regulations adopted September 8, 2007 (as previously amended), and any other prior Association rules in conflict. The purpose of the restatement is to: consolidate the Association's rules into a single, current document; bring the Association's enforcement and architectural-review procedures into compliance with recent changes to the Davis-Stirling Common Interest Development Act, including Assembly Bill 130 (effective July 1, 2025); and restate, without substantively changing, the use restrictions already found in the Declaration and the Association's existing practice.

If adopted, the Proposed Association Rules would affect every Member and Occupant, since they govern, among other things: general conduct and quiet hours; use of the Common Area, beach, pier, and boat-launch facility; canal and waterfront/dock use; property maintenance and tree preservation; architectural review of exterior changes; parking, vehicles, and RV/trailer storage; boating, skiing, and water safety; swimming and beach safety; pets; tenant and guest privileges and the minimum lease term; enforcement procedure and fines; and dispute resolution.

Summary of Significant Changes

The following is a plain-language summary for Members' convenience. It is not a substitute for the complete Proposed Association Rules, which are described under “How to Review the Complete Document” below.

  • Enforcement and fines are updated to match Assembly Bill 130: most fines are capped at $100 per violation (higher fines require a written Board finding, at an open meeting, that the violation affects health or safety); no late charges or interest may be added to a fine; and Members have a guaranteed opportunity to cure a violation before any hearing.

  • An updated Architectural Review Procedures article states the Architectural Committee's 30-day response time, the six-month construction-completion window, and a Member's 30-day right to appeal a denied or conditionally approved application to the Board.

  • The enforcement process, which appeared in three different, inconsistent places in the prior draft, is consolidated into one clear procedure.

  • The Tenant and Guest Rules restate the Declaration's 30-day minimum lease term and the information an Owner must file with the Association before a Tenant may use the recreational facilities.

  • The community bulletin board policy is updated to use neutral posting rules (size, dating, duration) rather than Board pre-clearance of content, for consistency with Members' rights under Civil Code section 4515.

  • The Canal and Waterfront article carries forward the existing dock-dimension standards (including the approved dock-configuration diagrams) without change.

  • The number of consecutive days a boat may occupy the floating dock's overnight-parking side (the 2007 rule allowed 7 days; this draft proposes 3).

  • The loading/unloading time limit on the east side of the dock (the 2007 rule allowed 15 minutes;  this draft proposes 30 minutes).

  • The Association's boat permit and display program described in the 2007 rules is retired.

How to Review the Complete Document

The complete text of the Proposed Association Rules is posted on the Association's website at konotayeehoa.org, on the Announcements page and in the Member/Document Library, and is available at the community bulletin board at the mailboxes. A copy is also available upon request from the Secretary at secretary@konotayeehoa.org.   

How to Submit a Comment

A Member may submit a written comment on the Proposed Association Rules, in whole or in part, at any time before the deadline stated above, by any of the following methods:

  • Online website comment form

  • By email to the Association's Secretary secretary@konotayeehoa.org

  • By mail to Home Owners of Kono Tayee Estates, Attn: Secretary, 7897 Richard Drive, Lucerne, CA 95458; or

  • In person or in writing at any Board meeting held before the deadline.

The Board will consider every timely comment before voting on final adoption. A Member need not comment on the entire document — a comment on a single provision, including any of the items listed above, is welcome.

Next Steps

After the comment period closes, the Board will consider Members' comments and may revise the Proposed Association Rules in response before voting to adopt a final version at an open Board meeting on or after the date stated above. If adopted, the Association will provide Members General Notice of the adopted Association Rules and their effective date, consistent with Article 1.6 and 1.7 of the Proposed Association Rules.

Members' Right to Reverse an Adopted Rule Change

Members should be aware that, after a rule change is adopted, Civil Code section 4365 gives Members the right to reverse it by the vote described in that section. Information about exercising that right, if needed, will be included with the Association's notice of the adopted rule change.
