Notice of Fine Schedule and Enforcement Policy Updates

Dear Members,
The Board of Directors is proposing revisions to the Association’s existing Enforcement Policy and Fine Schedule. The proposed revisions are intended to update the Association’s current enforcement procedures and monetary penalty schedule to comply with recent changes to California law, including Assembly Bill 130 (AB 130), which amended Civil Code Section 5850.
The Association adopted its current Fine Schedule in August 2024. The proposed revisions do not create a new enforcement program, but instead update the existing policy to align with current statutory requirements.
The proposed revisions include:
Establishing additional due process procedures before disciplinary action or fines may be imposed, including hearing and notice requirements.
Providing owners with an opportunity to cure violations before fines may be imposed when the violation is capable of being corrected.
Eliminating the current $50-per-day continuing violation fine structure.
Revising the monetary penalty schedule to comply with new statutory limitations on HOA fines.
Limiting most fines to $100 per uncorrected violation unless the violation may result in an adverse health or safety impact and the Board makes the findings required by law.
Eliminating late charges and interest on monetary penalties.
Clarifying hearing procedures, member rights, Board decision notices, and Internal Dispute Resolution procedures.

Member Comment Period
Pursuant to Civil Code Section 4360, members are invited to submit comments regarding the proposed revisions.
Comments may be submitted in writing via the website or to: info@konotayeehoa.org and must be received by July 11, 2026.
Board Consideration of Proposed Rule Change
The Board will consider adoption of the revised Enforcement Policy and Fine Schedule at the following Open Board Meeting:
